Review of Civil Procedure Act 2005

The NSW Department of Attorney General and Justice reviewed the Civil Procedure Act 2005. The Civil Procedure Act 2005 provides a legislative framework in relation to practice and procedure in civil proceedings. The review was to determine whether the policy objectives of the Act remained valid and whether the terms of the legislation remained appropriate for securing those objectives.

Submissions closed on 31 March 2011.

Statutory review

Department of Communities and Justice completed a statutory review of the Civil Procedure Act 2005, which can be read here.

It was tabled in NSW Parliament in 6 August 2015

Outcome

The review concluded that the policy objectives of the act remain valid, and the terms of the act are generally valid in securing those objectives. The review however included 8 recommendations which focus on clarifying ambiguous provisions and promoting efficient operation of the act.
